Abstract

Mental health cases are increasingly the pioneering category of damages claims against health bodies, particularly in the context of Human Rights allegations. In this issue, two such decisions are reported. The case of Rabone, involving the suicide of an informal patient and reported on in the September 2009 and September 2010 issues, is scheduled to be heard by the Supreme Court in November 2011. Whatever the outcome, this is likely to be a landmark decision for the NHS.
